1. Overview

Welcome to ThisTrail (这里走) (the "App"), developed and operated by Kongjian Network Technology (Shanghai) Co., Ltd ("we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and us. Please read these Terms carefully. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to any part of these Terms, do not use the App.

We may update these Terms from time to time. Updated Terms will be posted on this page with the date revised. For material changes, we may also notify you through in-app notices or other reasonable means. Your continued use after changes become effective constitutes acceptance of the updated Terms.

2. Platform Role and Safety Disclaimer

The App is a software tool providing outdoor navigation and trail recording functionality. We act solely as an information platform and technology service provider, not as an outdoor activity organizer or safety service provider.

OUTDOOR ACTIVITIES INVOLVE INHERENT RISKS, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND OTHER DANGERS. These risks may arise from, among other things: terrain conditions, weather changes, wildlife encounters, equipment failure, getting lost, falls, physical exhaustion, and traffic accidents. Trail routes, track data, and navigation information provided through the App may be inaccurate, and actual real-world conditions may differ from information in the App.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM RESPONSIBILITY FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE APP. When using the App, you should:

  • Assess your own fitness, skill level, and the outdoor environment conditions.
  • Carry necessary safety equipment and backup navigation tools (paper maps, compass, etc.).
  • Monitor weather forecasts and official outdoor safety alerts.
  • Understand that GPS signals may be affected by terrain, weather, buildings, and other factors.
  • Exercise independent judgment and take responsibility for your own actions and safety.

3. License

Subject to your ongoing compliance with these Terms and payment of all applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal device for personal, non-commercial purposes. The App and all its content are the intellectual property of us or our licensors. This license is not a sale, and you have no rights other than to use the App in accordance with these Terms.

You agree not to, and not to assist or permit any third party to:

  • Copy, modify, decompile, reverse engineer, disassemble, or create derivative works of the App.
  • Rent, lease, lend, sell, or distribute the App.
  • Tamper with the App or circumvent any technology used to protect content.
  • Use the App for any commercial purpose without our express written consent.
  • Use automated tools (scripts, crawlers, etc.) to bulk collect or scrape data from the App.

4. User Accounts

You may need to register an account to use certain features of the App. When registering, you must provide true, accurate, and complete information and keep it updated. You are responsible for all activities under your account and must maintain the confidentiality of your account credentials. Notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from your failure to comply with these requirements.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to register an account. Individuals under 18 may use the App only with the supervision and consent of a parent or legal guardian.

5. User Content

The App may allow you to submit content including trails, waypoints, photos, reviews, comments, and other materials ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant us an irrevocable, perpetual, non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify, display, distribute, and otherwise exploit your User Content, including for commercial, promotional, and advertising purposes and for improving our products and services. This license authorizes us to make your User Content available to other users of the App.

Each time you submit User Content, you represent and warrant that:

  • You have all necessary rights and authorizations to submit the User Content.
  • Your User Content does not infringe any third party's intellectual property, privacy, or other rights.
  • Your User Content does not contain illegal, obscene, defamatory, threatening, harassing, or otherwise inappropriate material.
  • You will not collect usernames or email addresses of other users through User Content.

We reserve the right (but have no obligation) to review, edit, or remove User Content. We are not responsible for User Content and make no warranties regarding its legality or accuracy.

Privacy Notice: Your trails, waypoints, photos, and other content may contain precise location information. Be aware that content you post publicly may be viewed, cached, copied, or stored by others. We are not responsible for how others use your User Content.

6. Prohibited Activities

When using the App, you agree not to:

  • Upload or transmit viruses, malware, or any destructive code.
  • Interfere with or disrupt the App's servers, networks, or normal operation.
  • Access the App or others' accounts in an unauthorized manner.
  • Impersonate any person or entity or provide false identity information.
  • Trespass on private property or enter areas without permission.
  • Create excessive noise, litter, damage the environment, or disturb others in outdoor settings.
  • Use the App for any illegal, harmful, or improper purpose.

7. Intellectual Property

The App and all its content (including but not limited to software code, interface design, icons, trademarks, documentation, and data) are the intellectual property of us or our licensors, protected by applicable intellectual property laws. You may not copy, modify, distribute, display, or use any of the above without our prior written consent.

We welcome your feedback and suggestions. Any feedback you provide will be treated as non-confidential, and we may freely use it without compensation to you.

8. Third-Party Services

The App may contain links to third-party websites, services, or content, or integrate third-party SDKs/APIs (maps, social login, payment services, etc.). We make no warranties regarding any third-party services and are not responsible for their availability, accuracy, or security. Your interactions with third-party services are governed by their own terms and privacy policies.

The App may use artificial intelligence (AI) or machine learning features to enhance your experience. AI technologies have known and unknown risks and limitations and may make mistakes. You should independently verify AI-generated suggestions and results.

9. Fees and Subscriptions

The App's basic features are free. We may offer optional paid subscriptions or features, with pricing and payment terms clearly communicated at the time of purchase. Subscriptions purchased through the Apple App Store or other app marketplaces are governed by that marketplace's payment, refund, and cancellation policies. We reserve the right to modify fees and charges at any time; changes will be effective upon notice.

10. Disclaimers of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of accuracy, completeness, reliability, or suitability of information.
  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the App will be error-free, uninterrupted, or secure.
  • Warranties regarding the accuracy of trail routes, tracks, or outdoor condition data.

You understand and agree that actual real-world conditions may differ from information and data provided through the App. You are responsible for your own conduct and safety.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, NOR FOR LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability arising under these Terms or related to your use of the App exceed the greater of the fees you paid us in the past 12 months or RMB 1,000.

If you are dissatisfied with any portion of the App or these Terms, your sole and exclusive remedy is to discontinue use of the App.

12. Indemnification

You agree to indemnify and hold harmless us and our affiliates from any third-party claims, suits, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your use of the App, or your submission of User Content.

13. Service Changes and Termination

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, including feature changes, version upgrades, or discontinuation. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

We may suspend or terminate your access if: (1) you breach these Terms; (2) required by law; (3) your account is inactive for an extended period. Upon termination, your right to use the App immediately ceases, and we may permanently delete your data unless otherwise required by law.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China, excluding its conflict of law rules. Any dispute arising from these Terms shall first be resolved through friendly negotiation. If negotiation fails, either party may bring the dispute before a competent court at our domicile.

15. Force Majeure

We shall not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, epidemics, government actions, cyber attacks, or power/communications outages.

16. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full effect. Our failure to exercise or delay in exercising any right under these Terms shall not be deemed a waiver. You may not assign your rights or obligations under these Terms without our consent.
